Acceptance of Terms

By accessing or using the EcomTech platform ("Service"), operated by EcomTech ("we," "us," or "our"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you may not access or use the Service.

These Terms apply to all visitors, users, and others who access or use the Service. By using the Service, you represent that you are at least 16 years of age and have the legal capacity to enter into a binding agreement.

Account Registration

To use certain features of the Service, you must create an account. When creating an account, you agree to:

Accept responsibility for all activities that occur under your account

Interfere with or disrupt the Service or servers connected to the Service
Attempt to gain unauthorized access to any part of the Service or other systems
Use the Service to build websites that promote illegal activities, hate speech, or violence

We reserve the right to investigate and take appropriate action against anyone who, in our sole discretion, violates this provision, including removing content, suspending or terminating accounts, and reporting to law enforcement.

Intellectual Property

Your Content: You retain full ownership of all content you create, upload, or display through the Service, including text, images, logos, videos, and other materials ("Your Content"). By using the Service, you grant us a limited, non-exclusive license to host, store, and display Your Content solely for the purpose of operating and providing the Service.

Our Content: The Service, including its design, templates, code, graphics, and documentation ("Our Content"), is owned by EcomTech and is protected by copyright, trademark, and other intellectual property laws. You may not copy, modify, distribute, sell, or lease any part of Our Content without our written permission.

Templates: Templates provided through the Service are licensed for use on websites built with EcomTech. You may customize templates for your websites but may not redistribute, resell, or use them outside of the EcomTech platform.

Payment Terms

Free Plan: We offer a free plan with limited features. The free plan may be modified or discontinued at our discretion with reasonable notice.

Paid Plans: Paid subscriptions are billed in advance on a monthly or annual basis depending on the plan selected. All fees are quoted and charged in the currency specified at the time of purchase.

Billing: By subscribing to a paid plan, you authorize us to charge your provided payment method on a recurring basis until you cancel your subscription. You are responsible for keeping your payment information current.

Refunds: If you are not satisfied with our Service, you may request a refund within 14 days of your initial purchase. Refunds are not available for renewal charges. To request a refund, contact our support team.

Price Changes: We reserve the right to modify our pricing at any time. Price changes for existing subscribers will take effect at the start of the next billing cycle, and we will provide at least 30 days advance notice of any price increase.

Termination

You may terminate your account at any time by contacting our support team or through your account settings. Upon termination:

Your access to the Service will be revoked immediately
Your website(s) built on the platform will be taken offline
We will retain your data for 30 days, after which it will be permanently deleted
No refunds will be issued for unused portions of your current billing period

We may suspend or terminate your account at any time, with or without notice, for conduct that we determine violates these Terms, is harmful to other users or the Service, or for any other reason at our sole discretion.

Limitation of Liability

To the maximum extent permitted by applicable law, EcomTech and its directors, employees, partners, agents, and affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to:

Loss of profits, data, use, goodwill, or other intangible losses
Damages resulting from unauthorized access to or alteration of your data
Damages resulting from any interruption or cessation of the Service
Damages resulting from any third-party content or services accessed through the Service

In no event shall our total liability to you exceed the amount you have paid us in the twelve (12) months preceding the event giving rise to the claim.

The Service is provided on an "as is" and "as available" basis without warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

Indemnification

You agree to indemnify, defend, and hold harmless EcomTech and its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses, including reasonable attorney fees, arising out of or in any way connected with your access to or use of the Service, your violation of these Terms, or your violation of any rights of another party.

Governing Law

These Terms shall be governed by and construed in accordance with the laws of Bangladesh, without regard to its conflict of law provisions. Any disputes arising under or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts of Bangladesh.

Changes to Terms

We reserve the right to modify or replace these Terms at any time. If a revision is material, we will provide at least 30 days notice before the new terms take effect. What constitutes a material change will be determined at our sole discretion.

By continuing to access or use the Service after revisions become effective, you agree to be bound by the revised terms. If you do not agree to the new terms, please stop using the Service.

Severability

If any provision of these Terms is held to be unenforceable or invalid, that provision will be modified to the minimum extent necessary to make it enforceable, and the remaining provisions will continue in full force and effect.
